Terms of Service

Welcome to Unleeshed ("Unleeshed," "we," "our," or "us"). These Terms of Service ("Terms") form a binding agreement between you ("you," "your," or "User") and Unleeshed Inc. and govern your access to and use of our websites, mobile and desktop applications, APIs, and related services (collectively, the "Service").

By accessing or using the Service, you agree to these Terms, our Privacy Policy, and any policies or guidelines referenced herein. If you do not agree, do not use the Service.

1. Roles & Eligibility

User Roles

You must be at least 13 years old (or the minimum digital-consent age in your jurisdiction) to use the Service. If you are under 18, you represent that you have parental or guardian consent.

Creators and Partners acting on behalf of an organization represent that they have authority to bind that entity.

Unleeshed does not knowingly collect personal data from children under 13 without verified parental consent.

2. Account Registration & Security

You agree to:

• Provide accurate and current information
• Maintain the security of your credentials
• Be responsible for all activity under your account
• Promptly notify us of unauthorized access or security issues

We may suspend or terminate accounts for violations of these Terms, applicable law, or platform policies.

3. Content & Intellectual Property

3.1 User Content (Creators & Partners)

You retain ownership of content you upload or submit ("User Content").

By submitting User Content, you grant Unleeshed a worldwide, non-exclusive, royalty-free license to host, use, reproduce, modify, distribute, and display such content solely to operate, improve, and provide the Service, including AI processing you authorize.

You represent that:

• You own or control all rights to your User Content
• Your content does not infringe third-party rights
• Your content complies with all applicable laws

3.2 AI-Generated Output

Unleeshed owns the underlying AI models, system prompts, templates, and tooling.

Subject to these Terms:

• Creators own the narrative AI-generated output produced by their digital twins
• Partner usage of AI output is governed by executed Partner Agreements

3.3 Unleeshed Intellectual Property

All Unleeshed branding, software, interfaces, designs, and proprietary materials are owned by Unleeshed and may not be used without prior written permission.

4. Permitted Uses

4.1 Spectators

• Personal, non-commercial use only
• No scraping, redistribution, or reverse engineering

4.2 Creators

• Upload content and create digital twins you are authorized to use
• Monetize through the Service subject to platform terms
• Comply with editorial, usage, and community standards

4.3 Partners

• Use APIs and outputs only as permitted in executed agreements
• No resale or sublicensing without express permission
• Responsible for compliance in their own distribution environments

5. Payments & Revenue Share

• Commercial terms are governed by dashboards, Order Forms, or Partner Agreements
• Payments are processed via third-party providers
• Taxes, chargebacks, fraud reserves, and withholding may apply
• Late payments may incur interest up to the legal maximum

6. Privacy

We process personal data as described in our Privacy Policy. You are responsible for obtaining any required third-party consents before submitting content.

7. Service Changes

We may modify or discontinue features at any time. Material changes to paid features will be communicated in advance where required by law.

8. Disclaimers

8.1 Warranty Disclaimer

The Service is provided "as is" and "as available." We disclaim all warranties to the fullest extent permitted by law.

8.2 No Gambling or Financial Advice

9. Limitation of Liability

To the fullest extent permitted by law, Unleeshed is not liable for indirect, incidental, or consequential damages. Our total liability is capped at the greater of $100 or the amount you paid to Unleeshed in the prior 12 months.

10. Indemnification

You agree to indemnify and hold harmless Unleeshed from claims arising from:

• Your content
• Your use of the Service
• Violations of these Terms or applicable law

11. Termination

We may suspend or terminate access immediately for violations of these Terms, applicable law, or platform policies. You may terminate your account at any time through account settings. Provisions intended to survive termination will remain in effect.

12. Dispute Resolution & Governing Law

Informal Resolution:

Arbitration:

Disputes unresolved informally will be resolved by binding arbitration in New York, NY under AAA rules.

Governing Law:

New York law governs these Terms.

13. Acceptable Use Policy

You agree not to:

• Upload unlawful, infringing, or harmful content
• Impersonate others or misrepresent identity
• Create unauthorized deepfakes or deceptive AI content
• Provide financial, legal, or gambling advice
• Circumvent fees, rate limits, or security
• Scrape, bot, or reverse engineer the Service

14. Content Moderation & Enforcement

Unleeshed may review, remove, restrict, or disable content or accounts at any time, with or without notice, if we believe content or conduct violates these Terms, applicable law, platform policies, or community standards. We are not obligated to monitor content but reserve the right to do so.

Users may report content through in-app tools or by emailing admin@unleeshed.ai.

15. Creator-Specific Terms

By uploading content or creating a digital twin, you expressly consent to Unleeshed's processing, reproduction, transformation, and AI-based synthesis of your voice, likeness, name, and expressive style, solely for purposes you authorize through the Service.

You may request takedowns or editorial adjustments subject to technical and contractual limitations.

16. Partner-Specific Terms

Partner use of the Service is governed by executed Partner Agreements. Partners are responsible for:

• Securing API credentials
• Attribution and labeling of AI content
• Compliance in their distribution environments

17. Monetization & Fees

Payouts are processed via third parties. Refunds, disputes, or violations may result in withholding. Pricing may be updated with notice.

19. Data, Training & Opt-Out

User Content may be used to operate and improve the Service. Where supported, Creators may opt out of model training. Data may be anonymized for analytics.

20. Beta Features & Feedback

Beta features are provided as is. Feedback may be used without restriction to improve the Service.

21. Export & Government Use

You must comply with all export control laws and U.S. sanctions.

22. Mobile & Third-Party Tools

App store rules may apply. Third-party tools and open-source components are governed by their respective licenses.

23. Communications

You consent to receive digital notices related to the Service. Marketing messages are optional. SMS terms apply where opted in.

24. Changes to These Terms

We may update these Terms with notice. Continued use constitutes acceptance.

You may opt out of arbitration within 30 days of acceptance by writing to:
